In October 2004 the Labour Government introduced Statutory Minimum Grievance and Disciplinary Procedures. For the first time every employee has the right to have a legal minimum procedure for dealing with grievances, dismissal and other disciplinary action.

For the first time every employee has the right to have a legal minimum procedure for dealing with grievances, dismissal and other disciplinary action.

This is great news for members who work in companies where Usdaw is not recognised and where there are no Agreed Procedures. It is an important breakthrough and builds on the right to be accompanied by your union rep, which was another positive initiative from the Labour Government.

For most Usdaw members it's business as usual. Most Usdaw members work in companies where the union has already negotiated comprehensive Grievance and Disciplinary Procedures. Our negotiated procedures are better than the statutory minimum procedures and give rights to full representation. Management and members should continue to follow them.

The Statutory Procedures underpin the Agreed Procedures and if an employer is in breach of the minimum standards a dismissal will be automatically unfair and extra compensation awarded.

However, while the new Rules give members rights which are to be welcomed, they also impose responsibilities. Members also have a duty to comply with the procedures and if they do not they can be penalised.

The new rules came into effect on 1 October 2004.

Usdaw has produced a handbook (available to download at the end of this text) outlining the new regulations. We hope that you will find this resource a useful tool.
