FLT driver prosecuted
By Tony Larkin
A fork lift truck driver working in a Hertfordshire sawmill has been prosecuted by the HSE for breaching health and safety legislation.
The FLT driver pleaded guilty to failing to take reasonable care for the health and safety of other persons under Section 7 of the Health and Safety at Work Act 1974 and was fined £1,750.
The man was driving his lift truck forwards with his forks loaded with 12 modular sheds which were blocking his vision. He struck another employee who suffered a fractured pelvis, cuts and bruises.
The company had carried out training, refresher training and retesting which the driver had received. His failure to follow the procedures he had been taught led to the HSE taking the prosecution.
HSE said "It is important that individuals are aware that they, as well as their employer, have duties under the law to take reasonable care of the health and safety of others who may be affected by their acts or omissions at work.
