Temperature at Work

Employers have a legal duty under the Workplace (Health, Safety and Welfare) Regulations 1992 (WHSW Regs 1992) to: maintain a reasonable temperature in the workplace.

This guide should help Usdaw safety reps in negotiating improvements to workplace conditions in times of excesive temperatures. Usdaw reps should negotiate with them, using relevant regulations MHSW Regs 1999 which inform employers how to manage health and safety in their workplace, WHSW Regs 1992 which cover all aspects of welfare issues in the workplace from temperatures to toilets, HSE guidance HSG 194 relating to thermal comfort in the workplace and HSE Food Information Sheet No3 regarding temperatures in places where food is handled.

The two sets of regulations MHSW 1999 and WHSW 1992 and HSG 194 are available from HSE books (priced) via the HSE web site. The Food Information Sheet No 3 is free to download from HSE  web site or contact the Health and Safety Section at Central Office.
