New rights preventing age discrimination
21 November 2003
The Government has announced that new regulations will be brought into force prohibiting age discrimination in employment and vocational training in October 2006. The Government has launched a consultation paper seeking views on its proposals to prevent age discrimination.
However the Government have controversially included a concept of "justifiable discrimination" that allows employers to discriminate against workers of certain age where the discrimination can be justified.
The example given is where a candidate for a job would not be employed for a "reasonable" period of time before they would be due to retire. In this instance the employer could be justified in refusing to give them the job.
The other big issue covered in the consultation and one with major implications for our members is retirement ages. Retirement ages set by employers will be unlawful under the new regulations unless they can be objectively justified.
Download a copy of Usdaw's full response. The Government will consult again on the draft regulations in the spring of next year.
